GENERAL TERMS
+ COPYRIGHT AND USAGE

THE COMMISSIONED ART IS FOR PERSONAL USE ONLY​​​​

  • I do not consent for my artworks, commissioned or not, to be used/made into an NFT/be linked to any blockchain or used in any
    AI image generation software.

  • You may not edit, trace/copy, alter, or claim any of my work as your own.

  • No reproduction of the piece with the intent to resell is allowed.

    • Printing with the intent to put it up on your wall or for any personal use is fine!

  • You may not use the piece as a brand logo, but using it as a Profile Photo/Header/etc is okay.

  • Please credit me, @MarshMarllowArt, if you post it elsewhere.

    • And if you can, please link my Twitter/Instagram or youtube💖

REJECTIONS

  • I can refuse a commission if I'm not comfortable with the commissioner's requests or if I'm not able to do it.

  • Any ill or inappropriate behaviour, towards me or in general, will not be tolerated and your commission will be cancelled (you will not receive any art from me and will receive a full or partial refund) + you will be blocked and/or blacklisted from commissioning me again.

USAGE

  • I retain all copyrights over the commissioned artwork, while you, the commissioner, retain the rights to the Intellectual property (IP).

    • Basically, if you commission me to draw your OC, I have the credits for drawing the artwork itself, but the OC / idea of the artwork belongs to you. Same idea with fanart (minus the OC part).​

  • I reserve the right to post the commissioned artwork online and be used in my portfolio.

The following is considered copyright infringement:​
 

  • Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.

  • Claiming the artwork as your own.

  • Altering the artwork without my consent.

PAYMENT

  • Payments will be in CAD and made through Paypal or Ko-Fi. I will ask which platform you would prefer.

    • Paypal: I will send an invoice after we discuss everything.

      • Please be aware there may be additional Paypal fees due to currency conversion!

    • Ko-Fi: I would recommend this for Donation Requests, but you can pay here anyway if you'd like.

  • Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval.

    • If you decide you want to cancel your commission, make sure to do it at the sketch stage to get a full refund!

    • If you can't pay the remaining half, I will hold on to the artwork until you can pay me. You will not receive the art until then.​​

  • Please don't send me any payment before I have agreed to give you a slot! I will set up a Paypal invoice first and then notify you when I send it.

  • Tips are optional, but appreciated! (since you-know-what eats up a lot of the total amount with its fees...🧍‍♂️)

CANCELLATION 
& REFUND POLICY

  • If I am unable to start/work on your commission due to health/personal life/etc, I will inform you. If you decide to cancel your commission instead of waiting, you will receive a full/partial refund.

  • If you decide to cancel your commission before I started it or during the initial sketch phase, you can get a full refund.

  • You will receive a partial refund if I'm past the sketch phase (ex. if I'm already working on lineart/colouring).

  • If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself, so please get in touch with me first!

  • "If you request a Paypal chargeback at any point when you were not allowed to ask for a refund, you will lose all the beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again." Basically, don't scam me.

PROCESS & DELIVERY

  • ​Once the commission has been approved, please provide references like photos, character sheets and/or an example sketch.

    • The example sketch can be stick figures/basic colours! I just need a general idea :)

  • After I sketch out a thumbnail for the piece, we can discuss how long it may take me and the price. 

    • I'll ask for half of the total payment (you can pay the full payment here if you'd like) while I work on the first sketch.

  • I'll continue updating you on how it's going and see if there are any changes you might want to be made.

    • You get 2 free "big" changes (ex. changing the pose or background idea), but after the limit, the time it takes to change/fix will be added on to the total cost.

    • Smaller changes (ex. adjusting the skin tone or fixing up a small detail) are free.​

  • The time it takes to finish your commission varies from 1 week to 1 and a half months depending on factors such as personal health, the complexity of the commissioned piece, other work, etc.

  • When I've finished the piece, I'll send you a low res version of the final piece and ask for the rest of the payment. Once I receive it, I'll email the files to you in a .zip file! 🥰

    • You will receive the full-resolution image (the size of the canvas I worked on), a web-friendly size (a smaller file that can be used as a profile/header more easily), and a 30 second timelapse of my process!

  • Note that these commissions are digital and there is no physical product.​

What do you get?

  • Full resolution file of the final drawing and a smaller version for internet upload if needed. The final file formats are in PNG.

  • CSP timelapse​ (30 seconds)
